General Information
Welcome to NEPAtoday.com (hereinafter the "Site"). The Site is owned and
operated by Pegasus Broadcast Television (hereinafter "PBT") with offices
located at 1181 Highway 315, Plains, PA 18702 USA. Your access to and
use of the Site is subject to rules, guidelines, policies, terms and conditions
contained in the within user agreement (hereinafter "User Agreement")
and all applicable laws. Please read the User Agreement carefully before
using the Site. BY USING THE SITE, YOU AGREE TO BE BOUND BY THE TERMS
OF THE USER AGREEMENT. If you do not agree with any of the terms of
the User Agreement you must not use the Site. If you are not at least
18 years old you may not use the Site without adult supervision. By using
the Site you warrant that you are at least 18 years old, are using the
Site under the supervision of a parent or guardian, or have the permission
of a parent or guardian to use the Site.
Your Acceptance of the User Agreement:

Termination of the User Agreement
This User Agreement is effective until PBT terminates it. If at any time

all materials and copies of materials obtained from the Site. If PBT determines
that you have not complied with any part of this Agreement, it may terminate
your access to the Site and any services provided by the Site. In the
event of termination, you are no longer authorized to access and use the
Site and you are required to destroy all electronic or other materials
and copies of such materials obtained from the Site. Your obligations
under the User Agreement, including the warranties made by you, and the
disclaimers and limitations of liability set forth herein will survive
the termination of the User Agreement.
Use of Intellectual Property
You may view and download materials displayed on this Site for personal,
non-commercial home use as permitted by applicable copyright laws. This
Site contains materials, including images, illustrations, audio clips,
video clips, and software, which are derived in whole or in part from
materials supplied by PBT and other sources that have licensed such materials
to PBT, and which are protected by U.S. and international copyright laws.
You must retain intact all copyright and other proprietary notices contained
on the materials. The materials may not be copied, reproduced, republished,
uploaded, posted, transmitted, used or distributed in any way, or decompiled,
reverse engineered, or disassembled for public or commercial purposes.
Modification of the materials is a violation of the copyright and other
proprietary rights. The use of any of the materials on any other World
Wide Web Site or networked computer environment is prohibited.
The trademarks, logos, and service marks displayed on this Site are owned
by PBT and by other sources that have licensed their use to PBT. Nothing

this Site without the written permission of PBT or such other source.
Your use of the marks displayed on this Site, except as provided in this

Complaints
NEPAtoday.com respects the intellectual property of others, and we ask
our users to do the same. NEPAtoday.com may, in appropriate circumstances
and at its discretion, terminate the access of users, subscribers, and
account holders who infringe the copyright rights of others.

Indemnification

parent companies and affiliates, from and against any and all claims,
actions, liabilities, costs and expenses, including without limitation,
reasonable attorney's fees, arising out of your breach of any provision
of this User Agreement or any warranty you provide herein, or otherwise
arising in any way out of your use of or postings to the Site.
Financial Information
In addition to, and without diminishing any other provision of this Agreement,
PBT assumes no responsibility for financial or securities information
provided on the Site. You hereby acknowledge that your reliance on any
financial or securities information received on or through the Site is
done at your own risk. You warrant that you will not engage in stock manipulation,
illegal proxy solicitation, or any other activity contrary to local, state,
or federal law, regulation of the U.S. Securities and Exchange Commission,
or any foreign law or regulation. PBT will not be liable to you or any
third party for any consequential, incidental, special or indirect damages,
including but not limited to lost profits, trading losses and damages
that may result from inconvenience, delay, or loss of the use of information,
even if PBT is advised of the possibility of such damages.
Fees
Access to and use of the Site is currently available without charge. PBT
reserves the right to charge a fee for access to the Site or use of the
Site, access to or use of parts of the Site or services available on the
Site at any time in the future. Your access to or use of the Site during
any time in which access is free does not entitle you to use the Site
without charge in the future.
Other
The User Agreement shall be governed by and construed in accordance with
the laws of the State of Mississippi without regard to its conflicts of
law provisions. You agree to submit to the personal jurisdiction of the
courts of the State of Mississippi for any cause of action arising out
of this User Agreement. If a court deems any part of this User Agreement
invalid, the remaining parts shall remain in full force and effect. You
agree to file any cause of action with respect to this User Agreement
and your rights and obligations in Hinds County, State of Mississippi
within one year after the cause of action arises. You agree that a cause
of action filed after this date is barred.
Changes to this Agreement
PBT reserves the right, in its sole discretion, to modify, change, or
alter the User Agreement at any time. You agree to be bound by such modifications
or updates and should therefore periodically visit this page to review
the then current User Agreement to which you are bound. PBT will attempt
to post a notice of any such change on the Site. By continuing to use
the Site after a change is made, regardless of whether PBT has posted
a notice announcing that change, you accept and are bound by the User
Agreement as modified. Only PBT or its affiliates may alter this Agreement.

Pegasus Broadcast Television ("PBT") strives to maintain an educational
playground for children and adults. We have put this section together
to provide information for our visitors about privacy and on-line safety.
As with any site on the Internet, any individual can observe the events
taking place. However, in order to participate in the interactive portions
of our NEPAtoday.com web site ("Web Site"), PBT requires users to register
and join NEPAtoday.com. Our registration form requests users to include
their name, e-mail address, home address and telephone number. This information
is used by PBT (and our Web Site hosting agents) to authenticate, confirm,
and communicate.
The interactive portions of our Web Site allow visitors to post information
and write content. Children can not participate in these interactive forums
without parental consent. As a protective measure, we request all individuals
to provide some information about themselves. Thus, if questionable material
is posted on our Web Site, we have the necessary information to track
down the source of the message and take the appropriate corrective measures.
PBT does not condition participation in an activity on the disclosure
of more personal information than is reasonably necessary to provide a
safe environment.
Personally identifiable information is collected via a registration form
that requests users to identify their name, e-mail address, home address
and telephone number. This information is kept by PBT (and our Web Site
hosting agents). PBT does not disclose personal information collected
from children or visitor/users to third parties (other than our web site
agents for the limited purpose of authentication, confirmation, and communication,
and who have agreed to maintain the confidentiality and security of the
information). Information collected from any site user is not used for
advertising, promotion or marketing purposes and is not released, sold,
or in any way transferred outside the company without the prior permission
of the site user. PBT firmly believes in safety and privacy on the Internet
and does not collect information about or disclose the identity of children
on the Internet without prior parental approval.
PBT is particularly dedicated to providing children with a safe and fun
Internet environment. PBT has developed privacy policies that are focused
on protecting children, and it is PBT' intention to adhere to the Children's
Advertising Review Unit ("CARU") Guidelines for Advertising on the Internet
and Online Services, as well as the Federal Trade Commission's Children
Online Privacy Protection Act ("COPPA"). Before children age 17 or younger
can interact with others at our site, we require that they obtain parental
consent.
If your child is age 17 or younger, we must obtain your parental consent
before your child can participate in NEPAtoday.com. PBT believes that
parents should actively supervise and participate in their children's
on-line activities. If you would like to review your child's personal
information or have it deleted and no longer want your child to participate
in NEPAtoday, please notify us at 570-970-5648 and we will make your requested
change within 48 hours.
PBT monitors all segments of the Web Site for objectionable content. If
you happen to see a posting anywhere on our Web Site that you feel is
objectionable, please notify us immediately at 570-970-5648. Further,
PBT recommends the use of parental control software tools that are readily
available from on-line services and software manufacturers. Such parental
software tools are designed to not only screen out objectionable content,
but also to allow parents to prevent their children from disclosing names,
e-mail addresses, home addresses, telephone numbers and other personal
information without parental permission.

Guidelines For The NEPAtoday.com Forums
Our goal is to allow as many people access to our service as possible,
and to promote communication between diverse groups of people. We want
you to have fun, and we want it to be with comfort and safety. To meet
our goal we have a few general guidelines. These guidelines were developed
to ensure that your experience with NEPAtoday.com is a positive one, and
that you'll keep coming back. Please remember these guidelines when you
chat, send mail, post to a forum, or share information or files.
1. Everyone on NEPAtoday.com is protected from harassment. We welcome
people of all ages, races, religions, genders. We won't tolerate expressions
of bigotry, hatred, harassment, abuse, or threats of harm to anyone. We
want to encourage discussion and exchange of ideas, not alienate people.
Sexually explicit material and/or language is not allowed in any form.
Foul language and swearing will not be allowed in the Forums in any form.
2. We only allow legal activities in the Forums. We won't let you
use the Forums to advocate illegal conduct, or participate in illegal
or fraudulent schemes. The Forums are not to be used to distribute unauthorized
copies of copyrighted material, including photos, artwork, text, recordings,
designs or computer programs. Anyone attempting malicious altering of
any Forum should be aware that it is a crime and they will have full charges
brought against them. Those charges are found in Title 17A, section 433
and are called Aggravated Criminal Invasion of Computer Privacy. It is
a felony with mandatory jail time no matter who you are.
3. We do our best to encourage safety and comfort, and discourage disruptive
communication. For your protection, computer programs that contain
destructive features, such as viruses, trojan horses, etc., are not permitted
anywhere. We discourage anything that disrupts communication. Chain letters
and pyramid schemes are not allowed. You will lose mail privileges if
you send or reply to chain mail.
4. Everyone on NEPAtoday.com is allowed one account. When you register
on NEPAtoday.com, you will have unlimited time to look around and find
areas that interest you. Our goal is to have you participate in the general
community life of NEPAtoday.com by participating in forums. We reserve
the right to restrict your account for any reason we see fit.
